An Istanbul court of the first instance delivered a landmark ruling saying that gay sex is natural, contradicting a previous ruling by Turkey’s supreme court.
Yesterday’s (18 February) judgment regarded a trader who was caught selling 125 DVDs of gay and group sex porn.
The person, known only by his initials, DM, faced up to four years imprisonment according to article 262/2 of the Turkish penal code that prohibits owning, trafficking, distributing and publishing ‘unnatural sex’ videos.
Judge Mahmut Erdemli, however, ruled that sexual orientation can not be considered as ‘unnatural’ and should be respected.
The verdict contradicted a previous ruling of Turkey’s supreme court that did include lgbtq+ sex in the category of ‘unnatural sex’.
In assist of his decision Erdemli cited examples of the legality of gay marriages in Europe and North America.

Turkish police arrest more than 50 people before banned Istanbul Pride parade
Police arrested more than 50 people in Istanbul on Sunday ahead of a banned LGBTQ+ Pride march, the city’s bar association said.
“Before today’s Istanbul Pride protest, four of our colleagues, including members of our Human Rights Centre, along with more than 50 people, were deprived of their liberty through arbitrary, unjust, and illegal detention,” the Istanbul Bar’s Human Rights Centre posted on X.
Earlier on Sunday, police arrested protesters near the central Ortaköy district, AFP journalists observed on the scene.
Once a lively affair with thousands of marchers, Istanbul Pride has been banned each year since 2015 by Turkey’s verdict conservative government.
“These calls, which undermine social peace, family structure, and moral standards, are prohibited,” Istanbul’s governor, Davut Gül, had warned on X on Saturday.
“No gathering or march that threatens public order will be tolerated,” he added.
Taksim Square, one of the city’s main venues for protests, celebrations and rallies, was blocked off by police from early on Sunday.

Some people in Turkey say with resentment that gay men are actually lucky, as at least they have one possible route out of military service - they don't have to use months in the barracks, or face the possibility of being deployed to fight against Kurdish militants.
But for openly gay men, life can be far from easy.
It is not uncommon for employers in Turkey to question position applicants about their military service - and a pink certificate can imply a job rejection.
One of Gokhan's employers found out about it not by asking Gokhan himself but by asking the army.
After that, he says, he was bullied. His co-workers made derogatory comments as he walked past, others refused to talk to him.
''But I am not ashamed. It is not my shame," he says.
Ahmet is still waiting for his case to be resolved. The army has postponed its decision on his pink certificate for another year.
Ahmet thinks it is because he refused to appear before them in woman's clothes. And he doesn't know what to expect when he appears in front of them again.
